Customer terms and conditions

When you make a booking with us the following terms and conditions will apply:

1.

Age:

You must be at least 18 years of age to use the Website and make a booking of any accommodation displayed on our site.

2.

General

We act as disclosed agent for third party suppliers and your contract is directly with them. Bookings are subject to the supplier's terms and conditions and policies and you should read these before proceeding with your booking. Our role as agent is limited to facilitating bookings and arranging documentation, payments and refunds, as applicable.

 

3.

Scope of Service:

The information that we disclose is based on the information provided to us by the properties and they are fully responsible for updating all rates, availability which appears on the website. While we take care, we cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information.   Any dispute (including in relation to pricing) must be resolved by you directly with the Property or third party provider, and we will not become involved in or mediate in relation to any dispute.

4.

Payment:

You must make payment for accommodation booked on the site at the time of booking and you agree to make payment via a debit to your nominated credit card. The amount debited will (subject to the following) be the amount shown on our booking page prior to you clicking the "Pay Now" button on that page. Depending upon the currency of the booking, your credit card's currency and the country in which your card was issued, your credit card provider may impose foreign exchange fees and other fees, which are in accordance with your arrangements with that credit card provider.

5.

Changes to Bookings:

If you want to change any details of your booking, you must contact our Customer Service Centre info@alluxia.comfor contact details. We will do our best to assist you, but cannot guarantee that changes can be made. Please note that, subject to your rights under the Australian Consumer Law:

  • bookings at certain accommodation providers, or in certain time periods, or for certain room types cannot be cancelled or changed; and
  • some accommodation providers may permit cancellations or changes but this may involve that accommodation provider imposing a charge,

and this information will be displayed (see cancellation policy) on the relevant property details page and the booking page, which you access prior to making a booking.
In addition, we apply an administration charge of $50 to all booking changes and permitted cancellations - this amount is displayed on the booking page (this is in addition to any cancellation charges imposed by the accommodation provider).
If you fail to cancel a booking and do not check-in in accordance with the booking made, you will be charged for up to the full amount of the booking made.

6.

Requirements upon Check-in:

We do not provide your credit card details to any accommodation provider and as such you will be required to provide a credit card imprint or equivalent at check-in to cover incidental charges.
The person registering at check-in must be at least 18 years of age.
You will need to comply with any check-in requirements of the accommodation provider which may include the provision of photo ID at check-in to ensure that your identity matches the booking identity. A record and/or copy of this photo ID may be retained by the accommodation provider to minimise the risk of fraudulent credit card usage and for verification purposes with your credit card provider in the event of disputation. This identification information may be supplied to us by the accommodation provider.

7.

Site Information:

We make every effort to ensure all information displayed on our site is accurate.  However, as considerable information is accessed from accommodation providers and posted by our customers, we are unable to guarantee the accuracy of all information nor are we able to guarantee that the site is free of errors or faults. We reserve the right to change information displayed on our site (including these terms and conditions) at any time without notice to you.  Links which are provided to any 3rd party site are for your reference only and we do not endorse and nor are we responsible for the content of those websites by virtue of the availability of a link to their site.

We will endeavour to correct errors and take appropriate action as soon as possible after being notified of them. Neither we nor the supplier/operator are under any obligation to honour bookings where there is a pricing error, even if you have received a confirmation email. In these circumstances we reserve the right to correct any pricing errors on the website and to either offer you the opportunity to keep your booking at the correct price or cancel your booking without liability.

8.

Liability:

Without affecting any of your statutory consumer rights that cannot be lawfully excluded or limited: a) we will not be liable for any losses, damages, liability, claims or expenses (howsoever caused, including negligence, and whether direct, indirect or consequential) arising from the use of or connected with our site or any products or services purchased on our site, and b) we make no warranty or representation as to the fitness or suitability of any product or service displayed on our site or any linked site. Where our liability cannot be excluded, to the extent permitted by law such liability is limited to the value of the booking made. You acknowledge that you will be liable for any illegal, improper, inappropriate or defamatory material which you may post to the Website and you will indemnify Alluxia, its Officers, Directors, and agents from any claim, demand or loss arising out of:

  1. your breach of this agreement
  2. your violation of any law or the rights of a 3rd party
  3. your use of this Website

You agree that you will not use the Website:

  1. for any commercial purpose other than the booking of accommodation as provided here
  2. to make any false reservations
  3. to cause harm to us or to any 3rd party

Fairness:

10.

Copyright:

Alluxia has copyright to all images and content on our Website, which may not be copied, saved or used in any format other than as incidental to your permitted use of the site.

11.

Insurance:

We recommend that all customers obtain travel insurance against cancellation or amendment fees as well as providing sufficient medical cover.

12.

Booking Fee:

We do not current charge a booking fee. A cancellation fee may apply to cover the cost of credit card transactions and administrative fees.

13.

Authority:

In the event that an accident, disaster or emergency is reported to have occurred in a country where you will or may be travelling, you authorise us to disclose to the Australian Government Department of Foreign Affairs and Trade details of your itinerary (including without limitation, transport and accommodation arrangements) and your contact details within Australia and overseas.

14.

Tax:

Prices include GST unless otherwise stated.

15.

Competitions:

Terms & conditions applicable to each promotional competition are displayed during the competition period on the relevant promotion landing page.

16.

General:

These terms and conditions are governed by the laws of Queensland, Australia. We receive payments from our accommodation suppliers for the provision of our booking service. All references to "we", "our" and "us" are references to Alluxia Pty Ltd. For information on how we deal with your personal information please refer to our privacy policy.
